4. Eligibility
- You are legally capable of entering into a binding contract under the laws of your country of residence.
- You are legally permitted to purchase and import the Products into the United Arab Emirates.
- If a minimum age applies under local law (for example, 18 years), you confirm that you meet that age requirement.
5. Pricing, Taxes & Customs (UAE & GCC)
- Currency. Prices on kuycon.ae are shown in United Arab Emirates dirhams (AED).
- Excluding VAT and import duties. All prices are listed exclusive of VAT, import duties and any other governmental charges, unless we expressly state otherwise.
- Import into the UAE (DAP). For deliveries to addresses within the United Arab Emirates, shipments are generally supplied on a DAP (Delivered At Place) basis under Incoterms® 2020. Shipping fees cover transportation and, where applicable, basic insurance only. UAE VAT (currently 5%) and any import duties, customs or clearance fees are not included and are payable by you to the courier or customs upon import.
- Import into other GCC countries (DAP). For deliveries to Bahrain, Kuwait, Oman, Qatar, and Saudi Arabia, shipments are generally supplied on a DAP (Delivered At Place) basis under Incoterms® 2020. Shipping fees cover transportation and, where applicable, basic insurance only. Any import duties, VAT, customs or clearance fees are not included and are payable by you to the courier or customs upon import.
- Importer of record. You acknowledge that, for shipments supplied on a DAP basis, you act as the importer of record for customs purposes and are responsible for completing any import formalities and paying applicable VAT, customs duties and related charges to the courier or customs authorities. This does not affect any obligations we may have towards you under applicable consumer protection and e-commerce laws. We do not issue UAE VAT invoices and do not currently collect UAE VAT on kuycon.ae. If this changes, we will update these Terms.
- Price changes. We may change prices at any time before you submit payment.
6. Payment Terms
- Accepted payment methods
We may accept some or all of the following methods (as displayed at checkout):- Visa, Mastercard, American Express, UnionPay, JCB, Diners Club and other supported credit/debit cards,
- Apple Pay / Google Pay or similar wallet solutions,
- Bank transfer in AED (and, where explicitly agreed, in other currencies).
- Timing and security
- Orders will be processed only after we receive cleared funds and complete basic fraud checks.
- If payment is not received or is reversed, we may cancel the order.
- Bank transfer / invoice payments
- If you choose to pay by bank transfer, instructions will be provided on the invoice.
- You must cover all bank and intermediary fees so that the full invoiced amount is credited to our account.
- If the amount received is lower due to fees or exchange rate differences, shipment may be delayed until the shortfall is settled.
- Refund method
- Where a refund is due, we will generally refund to the original payment method. If that is not possible, we may use an alternative method (such as bank transfer) at no extra cost to you.
7. Orders & Cancellations
- Order process
- By placing Products in your cart and completing checkout, you are making an offer to buy.
- We accept your order when we send an order confirmation email or otherwise confirm in writing.
- Changes and cancellations before shipment
- If you wish to change or cancel your order before it is shipped, please contact us as soon as possible.
- We may accept or refuse changes at our discretion. Additional costs (for example, difference in price, extra shipping fees) may apply.
- Our right to cancel
We may cancel all or part of an order and refund you if:- the Product is out of stock,
- we detect potential fraud or misuse,
- export control or sanctions rules would be violated, or
- there is an obvious error in pricing or product description.
8. Shipping & Delivery (UAE & GCC)
- Processing time
- Unless otherwise stated, we aim to dispatch orders within up to 3 Business Days after cleared payment (longer for custom or bulk orders).
- Transit time
- Delivery times depend on the shipping method, carrier performance, customs processes and your location. Estimated delivery windows may be shown at checkout but are not guaranteed. Deliveries to other GCC countries (Bahrain, Kuwait, Oman, Qatar, Saudi Arabia) may take longer than deliveries within the UAE.
- Shipping fees
- Shipping fees are shown at checkout and generally include transportation (and, where applicable, limited cargo insurance), but do not include any import VAT, duties or customs clearance fees payable on a DAP basis (see Section 5).
- Delivery address
- You are responsible for providing a complete and accurate delivery address and contact details.
- If a shipment is returned or delayed due to incorrect or incomplete information, additional costs may be charged to you.
- Split shipments
- We may ship items in your order separately, at no extra cost to you, if this speeds up delivery or is necessary for logistics reasons.
- Delays and your rights
- If delivery is significantly delayed so that you can no longer reasonably make use of the Product (for example, where a time-sensitive use is no longer possible), you may have rights under UAE law to cancel the affected order and obtain a refund. We will comply with such mandatory rights.
9. Risk of Loss & Title
- Risk of loss
- Risk of loss or damage passes to you when the carrier confirms delivery of the Products to your specified address or collection point.
- When the carrier has confirmed delivery. The carrier confirms delivery when its own tracking records the Products as delivered to that address. The carrier's delivery record governs, in whatever form that carrier keeps it: a signature, a hand-over to a person at the address, a driver photograph, a GPS position, a delivery scan, or placement where you, your household or your building instructed the carrier to leave shipments (an entrance, lobby, mailroom, parcel box, locker, concierge, reception or other safe place). A hand-over to a member of your household, to your employer, to your building's reception or security desk, or to a neighbour who accepts the shipment at the address is delivery to you.
- Loss after delivery. We are not responsible for Products that are stolen, taken by another person, mislaid or damaged after the carrier has confirmed delivery, and our cover for damage or loss in transit does not extend to them. If you believe the carrier's record is inaccurate, notify us in writing within seven (7) days of the recorded delivery; we will raise a trace or claim with the carrier at our own cost and give you the evidence the carrier provides. If the carrier determines that the shipment was not delivered to the address on your order, we replace it or refund you in full. If the carrier's evidence establishes delivery to that address, no refund or replacement is due under these Terms. Nothing here limits any right you have under mandatory consumer-protection law.
- Title
- Title to the Products and the right to dispose of them pass to you once we have received full payment and the Products have been handed over to the carrier at origin (outside the UAE), unless otherwise required by applicable law. For deliveries into the UAE you act as the importer of record (DAP, Incoterms® 2020); risk of loss nevertheless remains with us until delivery as set out above.
10. Inspection & Acceptance
- Inspection upon delivery
- You should carefully inspect the Products as soon as reasonably possible after delivery and no later than 48 hours.
- Reporting visible damage or shortages
- If there is visible transport damage, you should note this on the courier’s delivery record (if possible) and notify us promptly with photos.
- Any missing items or visible defects should be reported to us within 7 days from delivery.
- Deemed acceptance
- If you do not notify us within a reasonable period (normally 7 days) of any issues that were or should have been apparent on inspection, the Products will be deemed accepted for the purposes of any obvious issues only, without prejudice to your rights under the Limited Warranty, these Terms and mandatory UAE consumer protection law in respect of hidden defects or defects that appear later.
11. Returns & Refunds
Nothing in this Section 11 limits any mandatory rights you may have under UAE consumer protection and e-commerce law, including your right to a repair, replacement or refund without charge if a Product is defective, incomplete, damaged on arrival or not as described.
- Change-of-mind returns (UAE customers)
- We may, at our discretion, accept returns of unused Products in resalable condition if you contact us within 7 days of delivery and obtain a return authorisation (RMA).
- Products must be returned with all accessories, manuals, cables and in original packaging (or equivalent protective packaging).
- If packaging or accessories are missing, or the Product shows signs of use, we may refuse the return or deduct a reasonable restocking fee (for example, up to 15%).
- Payment processing fee: for change-of-mind returns, a payment processing fee may be deducted from your refund, depending on your payment method. This fee does not apply to refunds for warranty claims or defective products.
- Return shipping costs
- Change-of-mind returns: For change-of-mind returns accepted under Section 11.1, you are responsible for the cost and risk of returning the Products, unless we state otherwise in writing.
- Defects / damage / not-as-described: For returns due to defects, damage on arrival or incorrect/not-as-described Products, we will bear all return shipping and handling costs (prepaid return label or collection arranged at our expense), and no deduction will be made from your refund in respect of such costs, in accordance with applicable UAE consumer protection law.
- Faulty or not-as-described Products
- If your Product is faulty or not as described, please contact us promptly with details and supporting evidence (photos, videos).
- Where the issue is covered by the Limited Warranty or applicable law, we will, at no cost to you, provide a repair, replacement or refund, taking into account proportionality and feasibility and your statutory rights under UAE law.
- Non-collection / unpaid import charges (DAP)
- If a shipment is returned because required import VAT, duties or carrier fees were not paid, or because you did not arrange delivery/collection within the carrier’s deadline, we may cancel the order and refund the Product price minus our actual unrecoverable costs (including outbound and return freight, storage/handling and any non-refundable customs charges). Evidence of such costs can be provided upon request.
- Refund timing
- Refunds are processed after we receive and inspect the returned Products, or once a refund has been agreed for non-delivered goods.
- We aim to process refunds within a reasonable time, but bank or card-issuer processing times are outside our control.
- Payment processing fee: for change-of-mind returns, a payment processing fee may be deducted from your refund, depending on your payment method. This fee does not apply to refunds for warranty claims or defective products.
- Other GCC countries — your local rights
- Saudi Arabia: you may withdraw from your purchase within 7 days of receiving the Products and receive a full refund. Only the cost of returning the Products may fall on you, and no cancellation fee applies.
- Kuwait: you may return the Products within 14 days of delivery at no cost to you, and no cancellation fee applies.
- Qatar: where a cancellation right applies, no fee is charged within the first 3 days of the contract.
- Wherever the mandatory consumer-protection law of your country of residence grants you a stronger cancellation or refund right, that law prevails.
12. Limited 1-year warranty (UAE & GCC)
12.1 Scope – kuycon.ae orders only
We are an online retailer and distributor of Kuycon-branded products in the United Arab Emirates and other GCC countries. This Limited Warranty in Section 12 is issued by Kuycon L.L.C-FZ and applies only to new Products purchased directly from kuycon.ae for delivery within the United Arab Emirates or other GCC countries (Bahrain, Kuwait, Oman, Qatar, Saudi Arabia).
If you purchased a Kuycon-branded product from any other website, marketplace or seller, your contract and warranty rights are against that seller. We are not a party to such sales and do not provide warranty or after-sales services for those purchases under these Terms. Your statutory rights, if any, against that seller or the manufacturer are not affected.
12.2 Unauthorised sellers and grey imports
We may refuse to provide warranty or after-sales services under this kuycon.ae Limited Warranty for Products that:
- (a) were not purchased from kuycon.ae and you cannot provide proof of purchase from kuycon.ae; or
- (b) were purchased from resellers or marketplace sellers that we have not listed as authorised Kuycon partners in the UAE on kuycon.ae website explicitly; or
- (c) have had their serial numbers removed, altered or defaced.
In such cases, any rights you may have will be against the seller from whom you purchased the Product.
12.3 Warranty coverage
We warrant that Products purchased on kuycon.ae will, during the Warranty Period, be free from manufacturing defects and will conform in all material respects to the specifications published on kuycon.ae when used under normal intended conditions. The Warranty Period is 12 months from the date you receive the Product, unless we clearly state a different period for a specific Product.
12.4 Warranty remedies
If a covered defect appears during the Warranty Period, we will, at our cost and in accordance with applicable UAE consumer protection law, repair the Product, replace it with a new or refurbished equivalent Product, or refund the purchase price.
If we are unable to repair or replace within a reasonable time, or if the same defect recurs multiple times, you may be entitled under UAE law to request a replacement or refund. We will honour any such mandatory statutory rights.
12.5 Pixel Defect Policy
Kuycon monitors are manufactured to meet ISO 9241-307 Class I standards.
Under this policy, a display may have up to 1 bright pixel, 1 dark pixel, or 2 stuck sub-pixels per million pixels. For Products purchased on kuycon.ae, if your unit has more than 1 defective pixel of any sort per million pixels, it qualifies for replacement or another warranty remedy under this Limited Warranty.
12.6 Other defect definitions
Covered defects also include, for example:
- Failure of critical components (such as power supply or video inputs);
- Severe display faults (permanent lines, major back-light bleed, significant colour distortion), provided they are not caused by external damage or misuse.
Exclusions include minor pixel anomalies within the above policy, normal cosmetic wear, damage caused by misuse, accidents, unauthorised modifications, incorrect installation or use contrary to the instructions.
OLED image retention and burn-in. Products with an OLED or QD-OLED panel are subject to image retention and, over time, to permanent burn-in where the same static content — a taskbar, a game HUD, a station logo, spreadsheet gridlines, a stationary window — is displayed for extended periods, especially at high brightness. This is an inherent characteristic of the panel technology and a form of gradual wear, not a manufacturing defect, and it is not covered by this Limited Warranty. Image retention and burn-in are governed by this paragraph rather than by the general categories of covered defect listed above. Keep the built-in panel protections enabled (pixel shift, panel refresh cycle, automatic brightness limiter), vary what is on screen, and let the display sleep. Whether a retained image or luminance non-uniformity is a covered defect is assessed by Kuycon on a full-screen solid-colour test and, where the panel reports them, on its own usage and pixel-refresh counters. A fault confirmed on that test is covered. This paragraph limits only this voluntary Limited Warranty and does not affect any mandatory rights you have under applicable UAE consumer protection law.
12.7 Claim procedure
To make a warranty claim, email [email protected] with your order number, a description of the issue and supporting evidence (such as photos or videos). For valid warranty claims in the UAE and other GCC countries, return shipping is on us: we send a prepaid return label or arrange collection at our expense and bear all round-trip shipping costs, in accordance with applicable consumer protection laws.
12.8 Territorial scope
This Limited Warranty applies only to orders placed directly on kuycon.ae for delivery within the United Arab Emirates or other GCC countries (Bahrain, Kuwait, Oman, Qatar, Saudi Arabia).
13. Disclaimer of Warranties (to the extent permitted by law)
Except for the Limited Warranty in Section 12 and any rights and remedies that cannot be excluded under applicable UAE law (including Federal Law No. 15 of 2020 on Consumer Protection and Federal Decree-Law No. 14 of 2023 on Trading by Modern Technological Means), the Site and Products are provided “as is” and “as available”, without additional express or implied warranties, including implied warranties of merchantability, fitness for a particular purpose or non-infringement, to the maximum extent permitted by law.
14. Limitation of Liability
- No exclusion where unlawful
- We do not exclude or limit liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited under applicable UAE law.
- Limit of liability per order
- To the extent allowed by law, our total aggregate liability for any loss or damage arising out of or related to a specific order (whether in contract, tort or otherwise) is limited to the total amount you paid for the Product(s) in that order, except where a higher amount is required to satisfy your mandatory rights to compensation under UAE consumer protection law.
- Excluded types of loss
- To the extent allowed by law, we will not be liable for:
- loss of profit, revenue or business,
- loss of data,
- indirect or consequential damages.
- To the extent allowed by law, we will not be liable for:
This Section 14 does not affect your statutory rights or any rights you may have to claim compensation under mandatory UAE consumer protection law.
15. Export Controls & Sanctions
You agree to comply with all applicable export-control and sanctions laws and regulations. You represent that you are not located in, and will not use the Products in or for the benefit of, any country or person subject to comprehensive sanctions or export restrictions applicable to us.
16. Governing Law & Dispute Resolution
- Governing law
- These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them are governed by the laws of the United Arab Emirates, without regard to conflict-of-law rules.
- Jurisdiction
- Subject to any mandatory consumer-protection rights that allow you to bring claims elsewhere, the courts of Dubai, United Arab Emirates shall have jurisdiction to hear disputes arising out of or in connection with these Terms.
- Informal resolution
- Before starting formal legal proceedings, both parties will use reasonable efforts to resolve the dispute amicably, for example by contacting customer support and allowing a reasonable time to respond.
Nothing in this Section 16 prevents you from submitting a consumer complaint to the Ministry of Economy or other competent consumer protection authority in the UAE, where available under applicable law.
17. Electronic Communications
You agree that contracts, notices, disclosures and other communications that we provide electronically (including through the Site and email) satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law.
18. Miscellaneous
- Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
- Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to another entity in connection with a merger, acquisition or sale of assets.
- Entire agreement: These Terms together with your order confirmation constitute the entire agreement between you and us regarding the purchase of Products from kuycon.ae.
- Headings: Headings are for convenience only and do not affect interpretation.
